§ 5. Exercise of corporate powers.

  • The corporate powers hereby vested in the City of Shelby shall be exercised, controlled and managed by a city council and a mayor for said city. Said councilmembers of said city shall form one (1) body to be known as the city council, and a majority of them shall constitute a quorum and be competent to perform all duties. The city council shall consist of six councilmembers, one (1) for and from each ward aforesaid [section 4].

    Editor's note— Although not specifically amending, repealing or superseding this section, the provisions of Session Laws of 1961, chapter 509, creating the office of city manager in and for the City of Shelby, have effectively transferred some of the corporate powers of the former board of aldermen to the city manager. See the editor's note to the title "Charter." Session Laws of 1961, chapter 416, section 2, effectively amended section 5 of the Charter by increasing the number of former aldermen from four to six.
