§ 16. Failure to qualify for office, penalty.

  • That any person elected mayor or councilmembers under the provisions of this Charter, refusing to qualify and act as such for one (1) month after such election shall forfeit and pay the sum of two hundred dollars ($200.00), one-half to the use of the person suing for the same and the other half to said city, to be applied by the councilmembers of said city to the use and benefit thereof; the said sum shall be recovered in any ordinary civil action before a magistrate of the general court of justice of said county in the name of the State of North Carolina.
