§ 36-32. Members.

  • (a)

    Number; appointments; terms.

    (1)

    The planning and zoning board shall consist of 11 members, three of whom shall be appointed by the county commissioners. All members shall serve for terms of three years. All members of the board shall, before entering upon their duties, take and subscribe to the oath of office required to be taken by officials of the city.

    (2)

    The three members appointed by the Cleveland County Board of County Commissioners shall reside within the Shelby extraterritorial planning and zoning jurisdiction area. The eight members appointed by the city council shall be residents of the corporate limits of Shelby.

    (b)

    Vacancies. Vacancies occurring on the board shall be filled for the unexpired term by the governing body whose appointee has vacated office.

    (c)

    Compensation. The members of the board shall serve without pay, except that the governing bodies of the city and county may provide for a per diem for attendance at meetings, which amount shall be set from time to time.
