§ 18-2. Recreational fires; permit required.

  • (a)

    No person shall kindle or maintain any fire, or shall knowingly furnish the material for any such fire, or authorize any such fire to be kindled or maintained on or in any street, avenue, road, lane or public ground or upon any private lot within the city.

    (b)

    Recreational fires shall be allowed only when an inspection of the site has been completed and a permit has been issued by the Shelby Fire Marshal's Office. Recreational fires shall include but not be limited to: Campfires, cooking pits, bonfires and luminaries. It shall be the discretion of the fire official to deny any such recreational fire permit when in the official's judgment the fire would constitute a hazard to the City of Shelby and/or its residents. No permits shall be issued if a county or state-wide burning ban is in effect. Any condition resulting in emission of smoke that becomes a nuisance or result in complaints shall be extinguished.

    Exception:

    (1)

    Approved cooking devices;

    (2)

    Outdoor fire places and chimineas.
