§ 13. Board of adjustment and appeals.

  • (1)

    There is hereby created a board of adjustment and appeals to have and exercise the following powers:

    (a)

    To hear and decide appeals from any order, requirement, decision or determination made by the City of Shelby in the enforcement of this ordinance;

    (b)

    To hear and decide special exceptions to the terms of this ordinance upon which such board may be required to pass by subsequent ordinances;

    (c)

    To hear and decide specific variances under section 9, and under G.S. 63-32(b);

    (d)

    The board of adjustment and appeals that now exists under the city zoning ordinance of the City of Shelby shall be and constitute said board of adjustment and appeals for the airport zoning ordinance, and in addition to the powers herein enumerated; said board of adjustment and appeals shall be governed by the terms of the General Statutes of North Carolina, as set forth in G.S. 63-30—63-36;

    (e)

    The board of adjustment and appeals shall adopt rules for its governance and procedure in harmony with the provisions of this ordinance. Meetings of the board shall be held at [the] call of the chairman and at such other times as the board may determine. The chairman, or in his absence the acting chairman, may administer oaths and compel the attendance of witnesses. All hearings of the board shall be public. The board shall keep minutes of its proceeding[s] showing the vote of each member upon each question, or, if absent or failing to vote, indicating such fact, and shall keep records of its examinations and other official actions, all of which shall immediately be filed in the office of the board and shall be a public record.

G.S. 63-29 has been repealed. As instructed by the city, the reference to that section has been changed to read "63-30."
